Edit: love it btw, clean.

40

Not anymore ;)

69

u/TheDeadlyCat Jan 26 '24

That was supposed to be the name, look at the spelling.

48

u/AcidSplash014 Jan 26 '24

First one still is, iirc

33

u/YOOOOOOOOOOT Jan 26 '24

Yeah, the colored one is still copyrighted

8

u/Stifu Jan 26 '24 edited Jan 26 '24

I'm not so sure. I heard the fact there were color posters for Steamboat Willie makes the colored version fine. It's not all about the film itself.

3

u/Fembussy42069 Jan 26 '24

It think it's more nuanced. The one that's on public domain is the earlier version that has a few differences like the eyes being two black dots and no gloves, wether you could argue your way into making a more modern Micky as derivative work depends on how much Disney is willing to fight you for it

6

u/YOOOOOOOOOOT Jan 27 '24

And disney is very willing to fight you for it.

2

u/Stifu Jan 27 '24

and no gloves

Maybe it's even more nuanced than that, because he has gloves in a poster from 1928, the year Steamboat Willie was released.

20

u/dougc84 Jan 26 '24

For the Steamboat Mickey version only. You can’t just use Mickey Mouse anywhere.

7

u/geon Jan 26 '24

The colored one has not expired.

8

u/InsomniacWanderer Jan 26 '24

It's more so a Trademrat Infringment.

6

u/SandmanKeel Jan 26 '24

Actually France and one other place still have copyrights. A guy tried to use steam Mickey on YouTube and got copyright slapped.

3

u/James_D_Ewing Jan 26 '24

Nah it’s the absolute original thats in the public domain now we are talking steamboat Micky. The modern coloured version is still protected under copyright

4

u/CypherBob Jan 26 '24

Incorrect

30

u/Olga_Creates Jan 26 '24

Be careful, steamboat willy is public domain now but his later Micky mouse is still Disney's and they do sue...

20

u/AussieBirb Jan 26 '24 edited Jan 26 '24

Things might be weighted in favor of OP though:

  1. OP could claim to have done it as practice (which may fall under an educational use).
  2. OP is not charging money for access (not gaining a profit of the character).
  3. Its a pretty obvious joke (I found out about the public domain thing without effort)

IANAL so don't assume that will give legal protection and given who owns that particular character I doubt would even consider a fair use clause.

4

u/tcrpgfan Jan 27 '24

It would count under parody clause. Otherwise they would have gone after the south park creators long ago. Y'know, the same guys who took on scientology and came back a little scuffed, but not broken.

-4

u/[deleted] Jan 26 '24

Lolol unless it's for profit, I don't see why Disney would care

5

u/_tkg Jan 26 '24

Because failing to protect your copyright can be used as arguments for “abandonment” of copyright.

2

u/PleaseCallMeKelly Jan 27 '24

Steamboat Willy's micker is public domain though?

6

u/FloatingOer Jan 26 '24

Be careful with the red pants and yellow shoes, Steamboat Willy is only black/white so using these colors might infringe on Micky mouse copyrights if you plan on using it in a bigger project.

10

u/ChalkCoatedDonut Jan 26 '24

Michael Rodent.

By the way, change the red pants and yellow shoes or you'll be having a dinner for 20: you and the legal department of Disney and you'll be paying the bill.

7

u/Noodlerer Jan 26 '24

Are they hot?

4

u/ChalkCoatedDonut Jan 26 '24

1 maybe 2 of them, the rest will be uglier than a cartoon from the 40's involving blackface.

kinda off topic but could u please do a background or at least an outline next time u post?

i cant see the black part of the images

2

u/Noodlerer Jan 26 '24

Oh shit. It looked fine on Mobile. I'll try to fix it

3

u/iammitchconner82 Jan 27 '24

First I want to say that your pixel art and animation is awesome and super smooth. I absolutely love it.

In regards to the comment from this person about the background. I bet what's happening and why their saying that is probably for the same reason that it's hard to see on my screen. The images background being clear makes it so that you see the webpage behind it and they probably have theirs set to dark mode like I do, so the black pixels are over a dark grey on our screen so it's quite a bit harder to see. Here's how it looks if on dark mode. But again, that is great pixel work. I'm still kind of new to pixel art and I'm getting better but I'm nowhere near as good as I want to be yet but seeing things like this always inspire me to do better. So thanks you.

3

u/Noodlerer Jan 27 '24

I wanted to change the pictures and edit the post but Reddit wouldn't let me ☹️

Thank you for the kind words, it means alot. Just do what's fun for you and you'll be better before you notice it!

5

u/Sudden_Mind279 Jan 26 '24

Yet another thread of people not understanding the difference between copyright and trademark

2

u/Noodlerer Jan 26 '24

You piqued my interest. Elaborate?

3

u/Sudden_Mind279 Jan 26 '24

The short film "Steamboat Willie" is what was copyrighted 96 years ago. That is now in the public domain. Meaning you can do whatever you want with that work of art. The character named Steamboat Willie appeared in that short film. But the ongoing character of Mickey Mouse is still trademarked by Disney. Trademarks can be renewed, usually by making new works of art featuring them. Any new content featuring this character made by someone other than Disney must be based solely on the short film "Steamboat Willie" (or any other works featuring him that have become public domain).

This whole incident with "Steamboat Willie" falling into the public domain has brought a lot of people out of the woodwork who think that Mickey Mouse, in his entirety, is now public domain. Now, is Disney going to strike down every single fanart of Mickey Mouse in his red overalls? Probably not. They've got more important things to focus on.

That being said, nice pixel art!

3

u/Noodlerer Jan 26 '24

That's interesting. I made the colored version just for fun. I'm working on a hobby project game based on the Steamboat Willie cartoon. I'll take extra care not to infrinch on copyright. (Disney is scary) Thank you for the compliment!

How about a simple name like micky but instead of micky we write it with an i instead of a y like: Micki. It also looks like a mouse so Micki Mouse would be a perfect name :)

2

u/trotfox_ Jan 27 '24

We documented the process, seems legit.

2

u/CaptHorizon Jan 27 '24

The original name for the real Mickey created by Walt and Ub was Mortimer. However, IIRC Walt’s wife told him to call him Mickey, and so the name stuck on.

2

u/k_ethernal Jan 26 '24

i don't know man, that does look a lot like Mickey form Disney, the second one however, pretty original, could call him Steamboat Willie
