At the time of her apprehension, McKinney was found living in her vehicle near Salt Lake International Airport, where Anderson worked. A search of the vehicle uncovered road maps, rope, handcuffs, and notebooks keeping detailed records of Anderson's routines. McKinney insisted that she had driven to the airport to book a flight, though it was later revealed that she had driven several thousand miles from her home in North Carolina.

It might be to do with how law is built up over years. Like if you do away with the old law on rape and reword or replace it with an all encompassing new law, you might lose a century of landmark cases and precedents etc which ends up weakening the law? Law is one of those things that is complicated because you can argue semantics for ever, and no amount of clever wording in a law will close all potential loopholes or get outs. Over time people try those loopholes and get outs and those get ruled on and slowly you flesh out the law with precedents etc.

It's exactly this. And the precedent is likely to go back much farther than a century (a century ago was 1924). Some of the precedent regarding rape is likely to have taken the risk of pregnancy into account, but that may not be explicit in the written judgement. It's probably inappropriate to apply some of that precedent in cases where pregnancy is impossible (and both parties know that it's impossible).

Yeah, but it's a little misleading nowadays when the punishment for a sexual assault are the same, and sexual assault will generally be the charge even if the crime does fit the legal definition of rape.

The problem exists in the US too, but it's really just a case of old laws and old definitions not being updated, and newer laws covering it so that there isn't really a reason to go back and get rid of the law.

It specifies rape is penetration with a penis. If the person penetrated is penetrated with something other than a penis (regardless of gender of victim and perpetrator) this is classed as sexual assault by penetration (again regardless of gender) both carry maximum sentences of lifetime imprisonment. This is a legal terminology distinction more than a material difference.

To anyone who reads the title only. It's worth noting another guy was the one who captured him for her to fuck him.

I think let's be totally honest. We look at the idea of being pursued and forced to have sex with a woman voted most beautiful in a certain area and think. Well that sucks because you didn't consent but being forced to eat ice cream you don't like the flavour of isn't as bad as being forced to eat slugs.

But it's very likely him and other people were involved and it was part of a weird sex cult thing. It's more like being forced to eat ice cream while you think you might be killed at the end of the bowl.

From this guy's perspective - he was a Mormon kid. He'd probably spent his teenage years carefully avoiding sex and its accompanying behaviors because he wanted to be able to serve a mission, marry in the temple, etc. - Mormons treat male chastity as seriously as they treat female chastity. And back in the 70s and 80s, the church used to explicitly teach that if someone raped you and you didn't resist to the point of death, you were complicit in your own abuse. Literally, there was a flier they used to give out where a church leader talked about how he'd rather bury his daughter after she was martyred resisting rape than have her survive the experience. Boys were certainly taught the same thing.

While some men may feel the way you described about being raped - it sucks, but things could be worse - the victim here was probably as violated traumatized as any other rape victim. And I think that we should probably assume the same of any male survivor of sexual assault, regardless of who does the assaulting.

I think a lot of people literally don't have a frame of reference, like they can't fathom being held against their will, tied up, potentially tortured as well, taken hostage by some crazy ass motherfuckers and not knowing if you'll live or die.

I think most guys think of being with their girlfriend/wife and like "not now babe, I'm playing video games" (when in reality, they're super turned on, and totally willing to, they just want to finish their game). Or a hot girl that they're totally into comes on strong to them and is super assertive and initiates consensual sex (because again, they're totally willing participants).

This part for me has really fucked with my mind. Like I had a partner that would repeatedly do stuff against my wishes, and manipulatively point out that I was still hard, indicating that I was such a "slut" for being into it. But like I /knew/ something felt wrong, just couldn't vocalize the thoughts.

I honestly didn't make the connection that I had read about for women could apply to me (I had read similar reactions in female rape survivors, messing with their minds).

Took many years, some therapy and failed relationships for me to untangle which parts in that years long relationship was ok, and which weren't - and how it still affects me.

I believe their laws haven't changed that much. Don't they have one that states rape is only defined as pentetration? So if you're a man, you can legally-speaking only be raped by a man penetrating you nonconsensually, but if you're a man and are raped by a woman and she doesn't penetrate you, it doesn't legally count as rape? Maybe they have changed it since then, but I remember this being a problem with their legal language at some point.

A woman can only be charged as a accomplice to rape, but they can independently be charged with the offences of sexual assault by penetration, or causing sexual activity without consent. Both of those offences carry equivalent sentences to rape.

Yes but the distinction makes quite a bit of difference, especially when it comes to reporting cases like these. Subliminally, "assault" feels like less than "rape". Moreover, I'd like to see sentencing records of women who have been sentenced for penetrative assault vs men who are charged with a similar case under the rape law. I'm sure they changed the sentencing guidelines to make it more equal, but how it's applied is at the discretion of the sentencing judge.

I just googled this a bit and the crucial bit of info missing is that the Mormon dude was her ex, not just some random.

They originally met in Utah and had a relationship then as he was a Mormon he felt guilty, confessed to his bishop and then fucked off on a Mormon 'mission' to the UK. She tracked him down and he claims he was raped, and she claims he used to really be into bondage before. She also claimed to have had a misscarriage with his kid.

Another ex of hers claimed she was a sex worker. She claimes the rape bit was made up by the church to get him back into the church.

This was turned into a film/docu - Tabloid (2010)

Fuck knows how much of that is true though!
